Zakon o zapošljavanju stranaca od njegovog donošenja 2014. godine pa do danas pretrpeo je nekoliko izmena (2017, 2018, 2019. i 2023. godine), od kojih se ističu one koje su izvršene 2023. godine, kada je noveliran način podnošenja i obrade zahteva za izdavanje jedinstvene dozvole za privremeni boravak i rad stranca u Republici Srbiji (u daljem tekstu: jedinstvena dozvola). Ne iznenađuje volja zakonodavca da u tom delu izmeni Zakon, imajući u vidu digitalizaciju i tendenciju društva da primenom savremenih tehnologija dosadašnji “klasični” administrativni postupak, koji je bio zasnovao na postojanju obimne papirologije i fizičkog prisustva stranke pred nadležnim organom, zameni digitalnim, odnosno elektronskim načinom sprovođenja postupka. Novi način sprovođenja postupka, koji je počeo da se primenjuje od 1. februara 2024. godine, ne omogućava samo elektronsku komunikaciju između stranca i nadležnog organa nego i brži i jednostavniji način razmene podataka i sprovođenja nadležnosti između organa koji učestvuju u postupku izdavanja jedinstvene dozvole.
Bliži uslovi za podnošenje zahteva za izdavanje jedinstvene dozvole elektronskim putem, njegovu obradu, kao i uslovi za izdavanje jedinstvene dozvole i izgled obrasca jedinstvene dozvole uređeni su Pravilnikom o izdavanju jedinstvene dozvole za privremeni boravak i rad stranca („Sl. glasnik RS”, broj 6/2024). Naime, zahtev za izdavanje jedinstvene dozvole stranac podnosi popunjavanjem onlajn forme obrasca na jedinstvenom veb portalu za strance. Uz zahtev je potrebno da stranac priloži i propisanu dokumentaciju u formi elektronskog dokumenta u originalu ili u formi digitalizovanog dokumenta. Pored stranca, zahtev za izdavanje jedinstvene dozvole elektronskim putem može podneti poslodavac u ime stranca, odnosno lice koje oni ovlaste. Podnosiocu zahteva se, nakon podnošenja zahteva za izdavanje jedinstvene dozvole, dodeljuje jedinstveno elektronsko sanduče (eSanduče) koje služi za dalju komunikaciju podnosioca zahteva i organa, odnosno služi radi dostavljanja obaveštenja i uputstava za dalje postupanje.
Elektronskim putem je omogućeno i da se na pomenutom portalu, za vreme važenja jedinstvene dozvole, podnose zahtevi za dobijanje saglasnosti za promenu osnova rada, promenu poslodavca ili za zapošljavanje kod dva ili više poslodavaca.

The Foreign Nationals Employment Act, since its adoption in 2014, has undergone several amendments (in 2017, 2018, 2019, and 2023), among which those introduced in 2023 are particularly noteworthy. These amendments modified the procedure for submitting and processing applications for issuing a single permit for temporary residence and work of foreign nationals in the Republic of Serbia (hereinafter: the single permit).
The legislator's decision to amend the aforementioned Law in this respect is not surprising, given the digitalization of modern society and the general tendency to replace the traditional "paper-based" administrative procedure - characterized by extensive documentation and the physical presence of the applicant before the competent authority - with a digital, i.e. electronic procedure.
The new procedure, which has been in force since 1 February 2024, not only enables electronic communication between the foreign national and the competent authority, but also facilitates faster and more efficient data exchange and coordination among the authorities involved in the process of issuing a single permit.
Detailed conditions for submitting applications for a single permit electronically, their processing, as well as the requirements for issuing the single permit and the format of the permit, are regulated by the Rulebook on Issuing a Single Permit for Temporary Residence and Work of a Foreign National ("Official Gazette of the RS", No. 6/2024).
An application for issuing a single permit is submitted by a foreign national by completing an online application form on the unified web portal for foreigners. The application must be accompanied by the prescribed documentation, either in the form of an original electronic document or a digitized document.
In addition to the foreign national, the application may also be submitted electronically by the employer on behalf of the foreign national, or by a person authorized by either of them. Upon submission of the application, the applicant is assigned a unique electronic mailbox (eMailbox), which is used for further communication between the applicant and the authorities, as well as for receiving notifications and instructions for further action.
The portal also enables, during the validity period of the single permit, the submission of applications for obtaining consent for a change in the basis of employment, a change of employer, or employment with two or more employers.
